By downloading, installing, or using Starkive (the "Service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.
Starkive is a file encryption and delivery tracking application. It allows users to encrypt files, share them with recipients, and receive notifications when those files are opened. The Service is provided as-is during the beta period.
You may not use Starkive to transmit illegal, harmful, or infringing content. You may not use the Service to harass, surveil, or track individuals without their knowledge in violation of applicable law. You are solely responsible for the content of files you encrypt and share using Starkive.
You are responsible for maintaining the confidentiality of your account credentials. You are responsible for all activity that occurs under your account. Notify us immediately of any unauthorized use at support@depaloconsultingllc.com.
Starkive and its original content, features, and functionality are the property of Starkive and are protected by applicable intellectual property laws. The SSZ file format, open notification system, and associated software are proprietary to Starkive.
Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference.
The Service is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied. We do not warrant that the Service will be uninterrupted, error-free, or that open notifications will be delivered in all circumstances.
To the fullest extent permitted by applicable law, Starkive shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising out of or relating to your use of the Service.
We reserve the right to suspend or terminate your access to the Service at any time, with or without cause, with or without notice.
These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions.
We reserve the right to modify these Terms at any time. We will notify registered users of material changes via email. Your continued use of the Service after such notice constitutes your acceptance of the new Terms.
